Abstract

Abstract: This article looks at the meaning of economic activity and establishment in Regulation 1346/2000, article 2(h) and article 3(2). It will review what conditions must be met before secondary insolvency proceedings can be initiated in a foreign company which had its centre of main interest in another Member State.
