Abstract

Identifying essential differences between the criminal and civil jurisdictions, this article considers the the current approach of the civil courts to the definition of dishonesty, the reasoning behind the development of the law in this area, and whether and to what extent it is appropriate or even possible to identify common elements for a test for dishonesty across civil claims.
