Abstract

The article concerns the rule of law challenges associated with WTO antidumping law. More specifically, the article addresses the challenges for enterprises in accessing natural justice and locus standi; multilevel rule of law challenges in antidumping cases; and the challenges for WTO judiciaries in protecting law where national authorities have wide discretionary power. The article will in that respect discuss the different methodological approaches by WTO panels and Appellate Body and how it has affected rule of law.
